disregard for the Constitution has now come back to haunt the Obama administration. On Friday the United States Court of Appeals for the District of Columbia Circuit issued a scathing decision which nullified three other equally suspect recess appointments made by Obama last year to the National Labor Relations Board. According to the majority opinion of Chief Judge David Sentelle, Obama’s unilateral approach “would demolish the checks and balances inherent in the advice-and-consent requirement, giving the President free rein to appoint his desired nominees at any time he pleases, whether that time be a weekend, lunch, or even when the Senate is in session and he is merely displeased with its inaction. This cannot be the law.”
